This answer is not correct. This is an intermediate in the mechanism of this reaction and certainly exists for a short time. Whenever you can form a multiple bond to an oxygen atom, you will arrive at a more stable product (resonance). In this case, the chlorine atom is a good leaving group and the double bond can readily form.
